The end result is that you pay much more money to the creditor over a number of years than if you had paid the amount in full.
?If you think working directly with your Credit Card Company is a better idea, think again. A few things you should know.
First, There is no cap on the amount of interest a Credit Card can charge you. That’s right, your Credit Card Company can charge you 1000% interest a day if they want to.?Next, Your current interest rate can change with 45 days notice! When you read the fine print of your contract (and try to find all the other text it makes reference to) you will discover a brutal, deceptive and sleazy truth. The terms of your credit card (including interest) can be changed with 45 days notice which normally comes in that fine print document which accompanies your monthly statement. So if you think you have a 4% interest rate on your credit card for as long as you have the card, think again!?Finally, If a creditor cancels some of your debt, you have to pay taxes on that amount! Cancellation of debt is a taxable event which requires you to pay taxes for that money. This does not apply if a person receives a discharge in Bankruptcy. ?
Although the Obama administration has passed laws to help curb credit card company abuses, you still need to be very careful when dealing with the credit industry.?

-Next, I currently own a home and a car, will I lose them if I file Bankruptcy?
Probably not. Bankruptcy allows you to keep a certain amount of equity in your home and car despite filing bankruptcy. However, whether there is a chance of losing your home or your car should only be determined by an experienced bankruptcy attorney. -Next common question. What about Credit Card Debt consolidation companies? Can they help?

-Next common question. Do I need a lawyer to file Bankruptcy?
No. You do not. However, you’d be crazy to file without one.
Bankruptcy law is very complicated. So complicated, that Congress created a special court with special judges to hear these cases. Statistics show that people who file Bankruptcy on their own, have an overwhelming chance of having their case dismissed or not having all their debts discharged! When this happens, you get all the burdens of filing for Bankruptcy (filing remains on your credit report, same creditors harassing you, etc.) with none of the benefits (getting rid of your dischargeable debt!). This is why it is so important to have an experienced Bankruptcy Attorney working for you (not to mention piece of mind knowing an experienced Bankruptcy Attorney is handling your case).
-This leads to the next common question. How do I choose a good Bankruptcy lawyer?
In this tough economy everyone is hurting, including lawyers. And what you see is a lot of lawyers who have little or no experience in bankruptcy taking on these cases with devastating effects on their clients. Do not let this happen to you.
-When choosing a Bankruptcy lawyer, you should ask how many years of Bankruptcy experience they have, are they Board Certified in Consumer Bankruptcy law, do they keep up with recent developments in the law, do they write articles on Bankruptcy, are they a member or chairman of the Bankruptcy committee at their local bar association. Moreover, it is very important that you feel comfortable with your attorney. Remember, you are trusting someone with your financial future. Do not let that someone be just anyone. Demand the best.
-Final common question. Is it moral to file Bankruptcy?
Yes! Yes! Yes! One of the guiding principles of the founding fathers of this nation was that people should have the ability to get a fresh start. This is evidenced by the fact that the U.S. Constitution states that Congress shall have the right to promulgate laws on Bankruptcy. Congress would not permit Bankruptcy as an option if they felt there was something wrong or immoral about it. There are many policy reasons for having Bankruptcy as an option but one reasons stand out. If Bankruptcy was not an option and individuals were stuck with debts forever, the individual would probably work “off the books” to avoid having their wages garnished. This would lead to less tax revenues coming into the government to build schools, roads, hospitals, etc. In this scenario, no one wins! Not the creditor who is unable to collect, not the government due to no tax revenue being paid and last but not least, not the individual who will be “living in the shadows” unable to live as a constructive member of society.

-Did you know that most “Debt Consolidation” Companies who claim to be “non-profit” are wholly owned subsidiaries of the credit card industry! So when you hear a commercial for a debt consolidation company stating “we work with over 70,000 creditors to help you get your financial life back in order,” you now know what their true relationship is with these creditors. The credit industry knows that some money via a “debt consolidation” payment plan is better than no money if the person files bankruptcy.
-It is important to know that all a debt consolidation company does is call up your creditors and asks them if they are willing to accept less than the full amount currently due. The creditors will often say they will offer you a lower monthly payment and cut your total current balance by up to one half of the full amount due. So far so good. Now here comes the scam: They will increase the interest rate and have a payment schedule spanning many years with a prepayment penalty clause. The end result is that you pay much more money to the creditor over a number of years than if you had paid the amount in full.
-By the way, I recently heard an advertisement encouraging people to enroll in debt consolidation programs saying that the U.S. Government passed a credit card bailout which requires the credit card companies to clean their books by offering settlements to people with credit card debt. This is simply a lie. To these companies I say, shame on you.

The Texas Rangers have declared bankruptcy today thanks in large part them signing Alex Rodriguez to a $252 contract some years ago. That’s what you get in baseball when you try to sign a player that only a few teams can afford to keep. What a fair “game” Major League Baseball is.
